Privacy Policy

This Privacy Policy describes how Tap Innovations LLC ("Tap Innovations," "we," "us," or "our") collects, uses, stores, and protects information in connection with the APEX platform ("APEX"). It applies to all users of APEX, including partners, administrators, and authorized users accessing APEX through chatwithapex.com or any related domains.

We wrote this Privacy Policy to be read by real people, not just lawyers. If something is unclear, email us at privacy@discovertap.com and we will explain it in plain language.

✦ We collect only what we need to operate APEX.
We do not collect data to sell, trade, or monetize. Every piece of information we collect has a specific, operational reason.

✦ Your business data stays in your account.
Customer information, deal data, architectural designs, and conversation history belong to you and are not shared with other APEX customers, cloud providers, or any third party.

✦ We do not read your conversations.
Your interactions with APEX are processed by AI to generate responses for you. Tap Innovations personnel do not access, review, or monitor conversation content.

✦ We do not use your data to train AI models.
We have opted out of all model training programs across every AI provider we use, including Anthropic, AWS Bedrock, Microsoft Azure AI, Google Cloud Vertex AI, and OpenAI. Your data does not improve anyone's model.

✦ You can download your data.
You can download and export your data at any time through your account. When you close your account, your data is deleted immediately. Accounts that are 30 days past due and cancelled are also subject to immediate data deletion.

The rest of this policy provides the legal detail behind these commitments.

2. Who We Are

Tap Innovations LLC is the data controller responsible for your information. We are a Florida limited liability company operating the APEX multi-cloud solutions architect platform for MSPs, VARs, and technology partners.

3. Information We Collect

3.1 Account and Registration Information

When you create an APEX account, we collect:

  • Name and email address
  • Company name and type (MSP, VAR, etc.)
  • Billing address and payment method details (processed and stored by Stripe or your cloud marketplace — we do not store raw payment card data)
  • Account preferences and settings

3.2 Usage and Platform Data

As you use APEX, we automatically collect:

  • Log data: IP address, browser type, operating system, pages visited, time and date of access, and session duration
  • Feature usage: which APEX tools and features you use, frequency, and general interaction patterns
  • Error and performance data: crash logs, error messages, and performance metrics used to diagnose and fix issues

This data is collected in aggregate and used to operate, maintain, and improve APEX. It is not used to build individual behavioral profiles for advertising or sale. Critically, log entries never contain the actual content of your conversations with APEX. What gets logged is metadata only — things like timestamps, session IDs, request status codes, error types, and token consumption. Token consumption (the number of input and output tokens processed per request) is logged for billing, capacity planning, and subscription management purposes. It tells us how much compute was consumed — nothing more. The substance of what you said, what APEX responded, and the details of any architecture or deal you discussed is never written to any log file, monitoring system, or diagnostic tool. Ever.

3.3 Customer Data You Provide

When you use APEX to perform your work, you may input or generate:

  • Customer and prospect information
  • Cloud architecture designs and recommendations
  • Deal and opportunity details
  • Conversation history with the APEX AI assistant
  • Documents, proposals, and outputs generated through APEX

This is your Customer Data. We process it solely to deliver APEX functionality to you. We do not analyze it for our own purposes, share it with other customers, or use it in any way beyond operating the service on your behalf.

3.4 Communications

If you contact us for support, billing, or general inquiries, we retain those communications to resolve your issue and improve our support. We do not use support communications for marketing without your consent.

3.5 Cookies and Tracking

APEX uses cookies and similar technologies for:

  • Authentication: keeping you logged in during your session
  • Preferences: remembering your settings and display preferences
  • Security: detecting and preventing fraudulent or unauthorized access

We do not use advertising cookies, cross-site tracking, or third-party analytics that share your data with advertisers. You can control cookie behavior through your browser settings, though disabling certain cookies may affect APEX functionality.

4. How We Use Your Information

We use the information we collect for the following purposes only:

  • To create and manage your account and verify your identity
  • To deliver APEX features and functionality to you
  • To process payments and manage your subscription
  • To send transactional communications: receipts, security alerts, and service notifications
  • To diagnose technical problems and maintain platform stability
  • To detect and prevent fraud, abuse, or violations of our Terms of Service
  • To comply with legal obligations

We do not use your information for behavioral advertising, third-party data enrichment, or any purpose not listed above. If we want to use your information for a new purpose in the future, we will ask for your consent before doing so.

5. AI Processing and Model Training

5.1 How APEX Uses AI

APEX routes your inputs through AI language models to generate architecture guidance, recommendations, and responses. This processing is performed on your behalf and is the core function of the platform.

5.2 No Model Training — Ever

Your data is never used to train, fine-tune, evaluate, or improve any AI or machine learning model. This applies without exception to:

  • Tap Innovations' own systems and future APEX features
  • Anthropic (Claude AI models)
  • AWS Bedrock and associated Amazon AI services
  • Microsoft Azure AI and Cognitive Services
  • Google Cloud Vertex AI and associated Google AI services
  • OpenAI and associated OpenAI services
  • Any other AI or model provider we may use now or in the future

Tap Innovations has contractually opted out of all data-sharing and model improvement programs with each of the above providers. This is not a default setting we rely on — it is an explicit, documented opt-out that we maintain and verify as part of how we operate this platform.

5.3 AI Provider Data Handling

When your inputs are processed by an AI provider, those providers act as data processors on our behalf under data processing agreements that prohibit them from retaining, using, or disclosing your data for any purpose other than generating a response for you in that moment. Your inputs are not stored by AI providers beyond the immediate processing window required to generate a response.

6. How We Share Information

6.1 We Do Not Sell Your Data

Tap Innovations does not sell, rent, trade, or otherwise transfer your personal information or Customer Data to any third party for commercial purposes. Full stop.

6.2 Service Providers

We share limited information with trusted service providers who help us operate APEX. These include:

  • Stripe, Inc. — payment processing
  • Amazon Web Services — cloud infrastructure and hosting
  • AI model providers — as described in Section 5
  • Email and communication services — for transactional notifications only

Every service provider we work with is bound by a data processing agreement that restricts them from using your information for any purpose other than performing services for us. We do not allow service providers to use your data for their own marketing, analytics, or model training.

6.3 Legal Requirements

We may disclose information if required to do so by applicable law, regulation, court order, or valid legal process. Where permitted, we will notify you before complying with such a request. We will not voluntarily disclose information to law enforcement beyond what is legally required.

6.4 Business Transfers

If Tap Innovations is acquired, merges with another company, or sells substantially all of its assets, your information may be transferred as part of that transaction. We will notify you in advance and give you the option to download your data and close your account before any such transfer takes effect.

6.5 Protection of Rights

We may disclose information where we believe in good faith that disclosure is necessary to prevent fraud, protect the security of the platform, or protect the rights, property, or safety of Tap Innovations, our customers, or the public.

7. Data Retention

We retain your information for as long as your account is active or as needed to provide APEX services. Specifically:

  • Account and profile data is deleted immediately upon account closure or upon cancellation following 30 days past due
  • Customer Data (conversations, designs, outputs) is deleted immediately upon account closure or upon cancellation following 30 days past due. You may download and export your Customer Data at any time before closing your account
  • Billing and transaction records are retained for 7 years as required by financial regulations
  • Log and usage data is retained for up to 12 months and then deleted or anonymized

8. Data Security

We implement industry-standard security measures to protect your information, including:

  • Encryption in transit (TLS 1.2+) for all data moving between your browser and APEX
  • Encryption at rest for stored Customer Data
  • Access controls limiting employee access to customer data on a strict need-to-know basis
  • Regular security reviews and vulnerability assessments
  • Multi-factor authentication for APEX administrative systems

We do not access your Customer Data in the course of normal operations. Employee access to production systems is logged, audited, and requires explicit authorization.

No method of data transmission or storage is completely secure. In the event of a data breach that affects your information, we will notify you as required by applicable law and as promptly as circumstances allow.

9. Your Privacy Rights

Regardless of where you are located, you have the following rights with respect to your information:

9.1 Access

You can request a copy of the personal information we hold about you at any time. We will provide this in a portable, machine-readable format upon request.

9.2 Correction

If any information we hold about you is inaccurate or incomplete, you can request that we correct it. Most account information can be updated directly through your APEX account settings.

9.3 Deletion

Your Customer Data is deleted immediately when your account is closed or when your account is cancelled following 30 days past due. We do not offer on-demand deletion outside of account closure, but you are always free to close your account at any time to trigger immediate deletion. Certain records such as billing history are retained as required by law.

9.4 Portability

You can download and export your Customer Data at any time directly through your APEX account. No request or waiting period required — your data is always available to you in a structured, portable format.

9.5 Objection and Restriction

You may object to certain processing of your information or request that we restrict processing while a complaint or request is being resolved.

9.6 How to Exercise Your Rights

To exercise any of these rights, contact us at privacy@discovertap.com. We will respond within 30 days. We will never penalize you for exercising your privacy rights.

10. Children’s Privacy

APEX is a business platform intended for use by adults and organizations. We do not knowingly collect personal information from anyone under the age of 18. If you believe a minor has provided us with personal information, please contact us immediately at privacy@discovertap.com and we will delete it promptly.

11. International Data Transfers

APEX is operated from the United States. If you access APEX from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country.

We take appropriate safeguards to ensure that international transfers of personal data comply with applicable data protection laws, including implementing standard contractual clauses where required. If you have questions about how your data is handled for international transfers, contact us at privacy@discovertap.com.

12. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email and through a notice within APEX at least 30 days before the changes take effect. The updated policy will always be available at discovertap.com/privacy.

Your continued use of APEX after the effective date of any update constitutes your acceptance of the revised policy. If you do not agree to the updated policy, you may close your account before the effective date.
